Kingbiss operates this store and website, including all related information, content, features, tools, products, and digital or subscription-based services (including the KingBiss Gold Membership), in order to provide you, as a customer, with a curated shopping experience (the “Services”). Kingbiss is powered by Shopify, which enables us to provide you with the Services, and uses third-party applications to manage subscription and loyalty programs.

The terms and conditions set forth below, together with any policies referenced herein (these “Terms and Conditions of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms and Conditions of Service carefully, as they include important information about your legal rights and cover topics such as warranty disclaimers and limitations of liability. By visiting, interacting with, or using our Services (including purchasing TCG products or activating subscriptions), you agree to be bound by these Terms and Conditions of Service and our Refund and Privacy Policy. If you do not agree to these Terms and Conditions of Service, you must not use or access our Services.

By accepting these Terms and Conditions of Service, you represent that you have reached the age of majority in your state or region of residence and that you have provided us with your consent allowing any of your minor family members to use the Services on devices that you own, purchase, or manage.

To use the Services—including accessing or browsing our online stores, entering restricted areas, or purchasing any physical or digital products we offer—you may be required to register and open a customer account by providing certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all information provided in our store is accurate, up-to-date, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activities carried out on your account. Activation of the KingBiss Gold Membership is strictly personal and tied to the individual registered account: the system assigns a unique digital pass to the user’s profile. You may not transfer, sell, assign, share, or license your account or the benefits of your membership (including accumulated loyalty points and access to exclusive drops) to third parties. KingBiss reserves the right to suspend your account if suspicious shared access or fraudulent conduct is detected.

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that the colors or appearance of collectible items (including expansion packs, special boxes, and individual or graded cards) may differ from how they appear on your screen due to the type of device you use to access the store and your device’s settings.

In the Trading Card Game (TCG) sector, sealed products may feature variations in external artwork made by official manufacturers: KingBiss guarantees the authenticity and integrity of the factory seal, but is not responsible for any internal printing defects or misalignment of the cards contained in the packs.

All product descriptions are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Due to the limited nature of TCG allocations, Pre-orders, and Secret Flash Sales for Gold members, we expressly reserve the right to limit the quantities of any product that may be purchased per person, account, household, or order, on a case-by-case basis.

When you place an order or a pre-order, you are making an offer to purchase. KingBiss reserves the right to accept or reject the order for any reason, at its sole discretion. The order is not formally accepted until KingBiss confirms its processing and shipment. Payment must be received and processed before the order is accepted.

Special Rule for TCG Pre-orders and Allocations: Products purchased through pre-order are subject to the official allocations provided by distributors. In the exceptional event of a supply shortage beyond our control, KingBiss will give allocation priority to active Gold members and will promptly refund the portions of orders that could not be fulfilled.

Please review your order carefully before submitting it, as KingBiss may not be able to accommodate requests for cancellation or modification after the order has been accepted, especially for time-limited or pre-order items. In the event that your order is not accepted, is modified, or is canceled, we will attempt to notify you by contacting you at the email address and/or phone number you provided. Purchases are eligible for return or exchange only in accordance with our Refund Policy (TCG products must retain their original, unbroken seal). You represent and warrant that purchases are intended for personal or household use and not for speculative commercial resale.

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed. Unless otherwise expressly stated, published prices do not include local taxes, shipping and handling fees, customs duties, or import costs.

KingBiss Gold Membership Financial Terms: Activation of the membership requires a recurring subscription fee of €19.99, which is automatically charged every 30 days. You represent and warrant that you are the authorized holder of the payment method provided, and you authorize KingBiss to make recurring automatic charges through the Shopify platform and partner payment applications (Appstle). The membership price may change over time, subject to at least 30 days’ prior notice via email. You have the right to cancel or suspend automatic renewal at any time and without penalty through your user account dashboard before the next billing date. Renewals that have already been processed are non-refundable.

Loyalty Program Rules (Appstle Loyalty): Earning points and redeeming rewards (including the Skip-the-Line Token, Mystery Pack, ETB, and Booster Box) are privileges reserved exclusively for active Gold members. KingBiss reserves the right to cancel, reverse, or recalculate a user’s point balance in the event of refunded orders, canceled pre-orders, fraudulent behavior, or violations of these Terms. Accumulated points have no actual monetary value, cannot be converted into cash, are not transferable to other accounts, and expire immediately in the event of cancellation or non-payment of the Gold Membership. The top-ranked player in the monthly Hall of Fame will receive a physical prize at the team’s discretion, subject to verification of the legitimacy of the accumulated points.

You agree to provide up-to-date, complete, and accurate information regarding your purchases, payments, and account. You agree to promptly update your account information, including your email address, credit card numbers, and their expiration dates, so that we can process your transactions and contact you when necessary.

You represent and warrant that (i) the information provided is true, accurate, and complete, (ii) you are duly authorized to use this payment method for the purchase, (iii) the charges incurred will be honored by the issuing company, and (iv) the amounts charged will be paid at the published prices, including shipping costs and all applicable taxes.

All delivery times listed on the website or in tracking emails are to be considered purely indicative and do not constitute a contractual guarantee. KingBiss is committed to protecting the integrity of sealed TCG products by using eco-friendly and secure packaging to maintain the products' integrity.

Shipping Disclaimer: Once the goods leave our logistics hub and are transferred to our express shipping partner, legal ownership of the goods and the risk of loss or damage pass entirely to you. KingBiss is not liable for loss, theft, or shipping delays caused by carrier procedures or force majeure events, nor for tampering or alterations to the packages during transit. Any irregularities found on the exterior of the package (dented box, cut or wet tape) must be reported immediately and in writing to the carrier at the time of delivery by writing “Sign with Reservation of Inspection” on the delivery receipt. Damage resulting from shipping is the sole responsibility of the third-party shipping company and will not be reimbursed or compensated by KingBiss in any way.

Our Services, including, but not limited to, all trademarks, brand names, text, visual elements, Liquid/CSS source code, images, graphics, product reviews, videos, the point calculator simulator, and audio, as well as their design, selection, and arrangement, are the property of KingBiss, its affiliates, or its licensors and are protected by Italian, European, and international laws governing patents, copyright, and other intellectual property rights.

These Terms permit the use of the Services solely for personal, hobby-related, and non-commercial purposes. You may not reproduce, distribute, modify, copy the custom code, create derivative works, publicly display, publicly perform, republish, download, store, or transmit any material on the Services without our prior written consent.

Except as expressly provided in these Terms, nothing contained herein grants or shall be construed as granting any license or other rights with respect to the patents, trademarks, copyrights, or other intellectual property rights of KingBiss, Shopify, Appstle, or any third party. Unauthorized use of the Services constitutes a violation of intellectual property laws and will be prosecuted to the full extent of the law. All rights not expressly granted in these Terms are reserved by KingBiss.

KingBiss’s names, logos, product and service names, designs, and slogans are trademarks of KingBiss, its affiliates, or its licensors. You may not use these trademarks without KingBiss’s prior written consent. The names, logos, product and service names, designs, and slogans of Shopify and its partner applications are trademarks of their respective owners.

You may be provided with access to customer-facing tools, software, automations, and widgets offered by third parties as an integral part of the Services (including, but not limited to, recurring payment modules, point counters, simulators, and coupon redemption systems managed through the Appstle Membership and Appstle Loyalty platforms), which we do not directly monitor and over which we have no technical control or influence regarding the server infrastructure.

You acknowledge and agree that we provide access to these integrated tools “as is” and “as available,” without any warranty, representation, or condition of any kind on our part and without any endorsement of their overall performance. We shall have no liability of any kind arising from or related to your use of optional tools and third-party applications.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you understand and agree to the terms and conditions under which such tools are provided by their respective third-party providers (by reviewing Appstle’s license agreements). In the future, we may also offer new features through our Services. These new features will also be considered part of the Services and will be subject to these Terms and Conditions of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties, including any integrated third-party social media features or channels (such as dynamic badges and automatic redirects to our official TikTok, Instagram, and WhatsApp Helpdesk channels). We are not responsible for reviewing or evaluating the content, the stability of external chats, or the accuracy of third-party materials or websites that you choose to access. If you decide to leave the Services to access such materials or external chats, you do so at your own risk.

We are not liable for any damage or loss related to accessing third-party channels or to the purchase or use of external products, services, resources, or content. Carefully review the policies and practices of third parties and ensure that you understand them before engaging in any transaction or interaction. Complaints, requests, concerns, or questions regarding third-party products, software, and services should be directed to the third party in question.

Kingbiss is powered by Shopify, which allows us to provide you with the Services. However, all sales, monthly subscription transactions, and purchases made in our store are conducted directly and exclusively with Kingbiss.

By using the Services, you acknowledge and agree that Shopify is not liable for any aspect of the sales between you and Kingbiss, including any damages, injuries, tampering with packages by express carriers, or losses arising from the TCG products and membership services you purchase. You hereby expressly release Shopify and its affiliates from any and all claims, damages, and liabilities arising from or related to your purchases and transactions with Kingbiss.

All personal data we collect through the Services is subject to our Privacy Policy, which can be viewed here [/policies/privacy-policy]
, and certain personal data is necessarily subject to the provisions of Shopify’s Privacy Policy and those of our loyalty partner applications (Appstle), in order to properly track the awarding of points to your profile and the active status of your personal tag. By using the Services, you acknowledge that you have read this privacy policy.

Because the Services are hosted by Shopify and integrate with external databases to calculate rewards, Shopify and its software partners collect and process personal information related to your access to and use of the Services in order to provide and improve the Services. The information you submit to the Services will be transmitted to and shared with Shopify, as well as with third parties who may be located in a country other than the one in which you reside, in order to complete recurring billing and points redemption processes. Please see our Privacy Policy for more details on how we, Shopify, and our partners use and protect your personal data.

If you submit, upload, post, email, or otherwise transmit ideas, suggestions, feedback, proposals, plans, or reviews of purchased products accompanied by photographic material (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, and royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium and for any purpose, including commercial use on our social media channels to showcase the quality of our sealed packaging. We may, for example, exercise the rights granted by this license to promote the Services and to fulfill our obligations and exercise our rights under the Terms of Service.

You further represent and warrant that: (i) you own or have all necessary rights to all Feedback and uploaded images; (ii) the submission of reviews with photos for the scheduled accumulation of extra points under the Loyalty Program must correspond to an actual purchase verified on your account; and (iii) your Feedback will comply with these Terms. We are not and will not be obligated in any way to (1) keep your Feedback confidential; (2) pay monetary compensation for your Feedback; or (3) respond to your Feedback.

We may, without any obligation to do so, monitor, modify, or remove reviews and feedback that, in our sole discretion, we deem to be illegal, offensive, threatening, defamatory, libelous, obscene, false, or otherwise unacceptable, or that infringe on the intellectual property rights of any party or violate these Terms and Conditions of Service.

You agree that your Feedback will not infringe upon any third-party rights, including copyrights, trademarks, privacy rights, personality rights, or other personal or proprietary rights. You also agree that your Feedback will not include content that is libelous, defamatory, or otherwise illegal, unlawful, or obscene, nor will it contain computer viruses or other malware that could in any way affect the operation of the Services. You may not use a false email address, impersonate anyone else, or otherwise mislead us or third parties regarding the origin of any Feedback. You are solely responsible for any Feedback you provide and for its accuracy. We assume no responsibility and accept no liability for any Feedback posted by you or by third parties.

Occasionally, certain information about the Services or within the Services may contain typographical errors, inaccuracies, or omissions regarding product descriptions, prices, promotional rates, rules for earning loyalty points, insured shipping costs, courier transit times, and availability.

If such information is inaccurate or technical errors occur in the database, KingBiss expressly reserves the right to correct errors, inaccuracies, or omissions; to modify or update the information; or to cancel and refund orders at any time and without prior notice (even after the customer has submitted the order request). In the TCG marketplace, in the event of obvious inventory pricing errors caused by software bugs, the order will not be fulfilled and will be refunded in full.

You may access and use the Services solely for lawful purposes and for personal and collection purposes. You may not access or use the Services, directly or indirectly:

Furthermore, you agree not to: (a) upload or transmit viruses or any other type of malicious code; (b) reproduce, duplicate, copy, or clone the Light-Tech design, or extract or exploit any part of the Services; (c) collect or monitor the Personal Data of other members; (d) use robots, spiders, scraping tools, data collection and extraction tools, automated devices, or artificial intelligence tools (such as agent-based AI) to monitor product restocks; or (e) interfere with, circumvent, or evade security features, the digital lock on the Gold Members-Only Area, or membership authorizations. We reserve the right to suspend, disable, or terminate your account and reset your accumulated loyalty points at any time, without notice, if we determine that any part of these Terms has been violated.

14.1 This section applies if you use, permit, enable, or cause the implementation of an Agent to access, use, or interact with the Services. “Agent” means any software or service that performs autonomous or semi-autonomous actions on behalf of or at the direction of any person or entity and that can be executed on behalf of or through that person’s device, without direct supervision.

14.2 No Agent or automated bot may access, use, or interact with the Services unless it identifies itself at all times and operates in strict compliance with the technical requirements. Furthermore, no Agent may access, use, or interact with the Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may establish strict, non-negotiable limits—including through advanced technical measures and firewalls—on the terms and conditions under which an Agent may access, use, and interact with the Services, by blocking the Agent’s IP address and associated account.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request originates from an Agent and declare the Agent’s name by including the following in the request’s user-agent string: “Agent/[agent name]”; (ii) not conceal or obscure the fact that any access, use, or interaction originates from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) bypassing or circumventing CAPTCHAs or measures designed to distinguish computer-based use from human use; (iii) respond truthfully to any questions or prompts designed to determine whether interactions originate from a human or a computer; (iv) not circumvent or otherwise evade any measures designed to block, limit, modify, or control whether and how Agents access, use, or interact with KingBiss’s Services.

We may terminate this agreement or your access to the Services (or any part thereof, including the immediate revocation of your Gold Pass and loyalty points), at our sole discretion, at any time and without notice, in the event of a violation of the store’s rules of conduct, and you will remain liable for all contractual amounts due up to and including the date of termination.

You may cancel your Gold Membership at any time by turning off automatic renewal in your user account. Even in the event of termination or deletion of your account, the following sections will remain in full force and effect: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Governing Law, and Privacy Policy.

The information presented on or through the Services is provided solely for general informational and recreational purposes. We do not guarantee the absolute accuracy or completeness of this market information. Any reliance on such information or historical TCG quotes is solely at your own risk. We disclaim any liability arising from any reliance on such materials by you or any other visitor to the Services.

EXCEPT AS EXPRESSLY STATED BY KINGBISS CLUB, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND SUBJECT TO THE AVAILABILITY OF ALLOCATIONS FROM DISTRIBUTORS, FOR USE, WITHOUT ANY REPRESENTATION, WARRANTY, OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT, REPRESENT, OR ASSURE THAT THE USE OF THE LIVE STREAMING SERVICES WILL BE TIMELY, SECURE, OR FREE FROM TECHNICAL ERRORS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KINGBISS CLUB, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, SHALL BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND.

THIS INCLUDES, BY WAY OF EXAMPLE AND NOT AS AN EXHAUSTIVE LIST, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE AND FAILURE BY CARRIERS TO TAKE CARE OF PACKAGES), STRICT LIABILITY, OR OTHERWISE, ARISING FROM THE USE OF ANY SERVICE OR ANY COLLECTIBLE PRODUCT PURCHASED THROUGH THE SERVICES, OR FROM ANY OTHER CLAIM HOWEVER RELATED TO THE USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND SUFFERED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) PUBLISHED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE.

SECTION 18 - COMPENSATION

 
You agree to indemnify, defend, and hold harmless Kingbiss, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any loss, damage, liability, or claim, including reasonable legal fees, owed to third parties or arising from (1) a breach of these Terms and Conditions of Service or the documents incorporated herein by reference, (2) a violation of any law or the rights of third parties, or (3) your access to and use of the Services.
We will notify you of any claim for which you are liable to indemnify us; provided, however, that any failure to provide timely notice shall not relieve you of your obligations, unless you suffer substantial prejudice. We may control the defense and settlement of such a claim at your expense, including the selection of counsel, but we will not settle any claim that imposes non-monetary obligations without your consent, which shall not be unreasonably withheld. You will cooperate in the defense of indemnified claims, including by providing relevant documentation.

You may not delegate, transfer, or assign this Agreement or any of the rights or obligations set forth in these Terms without our prior written consent, and any attempt to do so will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or prior notice.

The headings used in this agreement are included solely for convenience and shall not limit or otherwise affect these Terms and Conditions of Service.
